Benefits Exist for Long-Term Care

The State of California offers benefits for:


Most Californians are unaware that these benefits exist, but they do.  These benefits are paid by the frail elderly division of Medi-Cal (the federal Medicaid program in California).  In fact, this program is currently paying for about 2 of every 3 patients in a nursing home today.


* Benefits for this type of care are extremely limited.


State Required Bankruptcy?

State regulations require that a single applicant have no more than $2,000 in available assets to receive benefits.  Many applicants are told they must spend down their assets on their own care before they will be eligible for benefits.  There are other options available, though.   


Medi-Cal and Estate Recovery

Federal regulations require that all 50 states seek reimbursement for amounts spent on behalf of a patient, except under certain hardship circumstances.  Because most patients have spent down to $2,000 or less, often the only remaining asset is the family home.  When an after-death estate claim is filed by the Estate Recovery division of Medi-Cal, it jeopardizes the most precious asset... the family home

The State of California allows its citizens to protect their assets from spend down  and estate recovery.  However, the methods must be followed exactly in just the right manner and in the proper timing.  A revocable living trust will not protect a patient's assets.  There is no single fix-all, no magic wand, no super-trust.  However, if you follow the rules, a patient's assets can be protected.

Medicare and Long-Term Care

If your loved one is in rehabilitation, paid for by Medicare, you need to consider a transition plan.  Medicare does NOT pay for long-term care.  While it does pay for rehab, the limitation is 100 days or less.  When rehab ends, the patient becomes responsible.  A care facility averages about $246 PER DAY in California - $7,000 per month.
